1. Introduction
Central Valley Mobile Mechanic is a service of Central Valley Automotive Inc. and its subsidiaries and affiliated entities under common ownership and control (“we,” “us,” or “our”). We respect your privacy and the information you share with us.
This Privacy Policy explains what personal information we collect through CentralValleyMobileMechanic.com (the “Site”), how we use and disclose it, and the choices and rights available to you. It applies to visitors to the Site and to people who contact us about our mobile repair services.
Central Valley Automotive Inc. maintains a group-wide privacy policy that also covers this Site. Where that policy addresses a topic in more detail, it applies alongside this one.
2. California Notice at Collection
The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), requires us to tell you at or before the point of collection what categories of personal information we collect and why. The table below summarizes our practices for this Site.
| Category | Examples we may collect | Why we collect it | Sold or shared? |
|---|---|---|---|
| Identifiers | Name, telephone number, email address, city or service location, IP address | To respond to your quote request, schedule service, and communicate with you | No |
| Customer records | Contact details you provide together with the vehicle and service information in your request | To prepare an estimate and perform the service you ask for | No |
| Commercial information | Vehicle year, make and model; the repair or maintenance you are asking about; service history with us | To diagnose, quote, and carry out repairs, and to keep service records | No |
| Internet or network activity | Pages viewed, referring page, browser and device type, approximate location from IP, and similar server log and analytics data | To operate and secure the Site, diagnose technical problems, and measure how the Site is used so we can improve it | No |
| Geolocation data (non-precise) | The city or address you give us so a technician can reach your vehicle | To confirm you are within our service area and to dispatch a technician | No |
We do not collect sensitive personal information through this Site. We do not sell personal information for money, and we do not disclose it for cross-context behavioral advertising. See section 6 for detail on how this applies to our use of analytics.
3. Information We Collect
Information you give us directly
When you submit the quote request form, we ask for your name, telephone number, the city or location of the vehicle, and a description of the problem or service you need. You may also provide your vehicle’s year, make and model, and an email address. The email address is optional and is used only so we can reply to you.
If you call us instead, we collect whatever information you choose to give us over the phone.
Information collected automatically
Like most websites, our hosting provider records standard server log information when you visit, which may include your IP address, browser type, operating system, the pages you request, and the date and time of your visit. This information is used to operate, secure, and troubleshoot the Site.
We also use Google Analytics, which collects information about how you use the Site through cookies. See section 7 for what it collects and how to opt out.
Information from other sources
If you were referred to us by one of the Central Valley Automotive dealerships, we may receive your contact and vehicle information from that dealership in order to follow up on your service request.
4. How We Use Your Information
We use the personal information described above to:
- respond to your quote request and answer your questions;
- schedule, dispatch, and perform mobile repair and maintenance services;
- prepare estimates and invoices, and keep records of work performed;
- contact you about your vehicle, an appointment, or a service we have provided;
- operate, maintain, secure, and improve the Site, including measuring how it is used;
- detect and prevent fraud, misuse, and unauthorized access; and
- comply with our legal obligations and enforce our agreements.
We do not use the information you submit through this Site to send you marketing messages unless you ask us to.
5. How We Share Your Information
We disclose personal information only as described here:
- Within our organization. Quote requests are sent to the service and management staff responsible for scheduling and performing the work, including staff at affiliated Central Valley Automotive entities.
- Service providers. We use vendors who act on our behalf and are permitted to use the information only to provide services to us — for example, our website host, email provider, and any scheduling or record-keeping software we use.
- Analytics provider. Google receives the usage information described in section 7 in order to provide analytics to us.
- Legal and safety reasons. We may disclose information where we believe it is required by law, subpoena, or other legal process, or where necessary to protect the rights, property, or safety of our customers, our staff, or the public.
- Business transfers. If our business or its assets are merged, acquired, or reorganized, customer information may be transferred as part of that transaction.
6. Sale or Sharing of Personal Information
We do not sell personal information collected through this Site for money.
We use Google Analytics to measure how the Site is used, as described in section 7. We have not enabled Google’s advertising features, so we do not disclose your information for cross-context behavioral advertising as that term is defined by the CCPA. If we enable those features in future, we will update this policy and provide a clear way to opt out.
We do not knowingly sell or share the personal information of consumers under 16 years of age.
7. Cookies and Similar Technologies
A cookie is a small text file placed on your device by a website. We use two kinds:
- Strictly necessary cookies. Set by our content management system and hosting provider so the Site functions and stays secure. These cannot be switched off without breaking parts of the Site.
- Analytics cookies. We use Google Analytics to understand how visitors find and use the Site so we can improve it.
Google Analytics sets cookies that collect your IP address, the pages you view and how long you spend on them, the site or search that referred you, your browser and device type, and an approximate location derived from your IP address. It does not tell us your name, and we do not attempt to identify you from it. This information is processed by Google on our behalf; Google’s handling of it is governed by its own privacy policy at policies.google.com/privacy.
We use analytics only to measure and improve the Site. We do not use it to build advertising profiles or to target ads to you across other websites.
How to opt out. You can install Google’s official browser add-on at tools.google.com/dlpage/gaoptout, which stops Google Analytics collecting data about you on any site. Most browsers also let you block or delete cookies, and many offer a “Do Not Track” or Global Privacy Control setting. Because the other cookies we rely on are strictly necessary, blocking those may affect how parts of the Site work.
The typefaces used on the Site are served from our own servers. Your browser does not contact any third-party font provider, so no third party receives your IP address for that purpose.
8. Your California Privacy Rights
If you are a California resident, the CCPA gives you the following rights, subject to certain exceptions:
- Right to know. You may request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties to whom we disclose it.
- Right to delete. You may request that we delete personal information we collected from you.
- Right to correct. You may request that we correct inaccurate personal information we maintain about you.
- Right to opt out of sale or sharing. We do not sell your personal information or disclose it for cross-context behavioral advertising. You can still opt out of analytics entirely using the methods in section 7.
- Right to limit use of sensitive personal information. We do not collect sensitive personal information through this Site.
- Right to non-discrimination. We will not deny you service, charge you a different price, or provide a different level of quality because you exercised any of these rights.
9. How to Submit a Request
To exercise any of the rights above, call us at 209-554-5724 or use the contact details in section 15.
We will need to verify your identity before acting on a request. Depending on what you ask for, that usually means confirming details we already have on file, such as the phone number or email address you used when you contacted us. We will not use the information you give us for verification for any other purpose.
You may use an authorized agent to submit a request on your behalf. We may ask the agent for written proof of authorization and may still ask you to verify your own identity directly.
We aim to confirm receipt of your request within 10 business days and to respond substantively within 45 days. If we need more time, we will tell you and explain why.
10. How Long We Keep Information
We keep personal information for as long as needed for the purpose it was collected, and afterwards only as long as required to meet legal, tax, accounting, warranty, or recordkeeping obligations, or to resolve disputes. Quote requests that do not become service appointments are kept only as long as needed to follow up on the inquiry.
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access or disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please do not send payment card numbers, Social Security numbers, or other sensitive identifiers through the quote form — we never ask for them there.
12. Third-Party Links
The Site may link to websites we do not operate, including the websites of Central Valley Automotive dealerships and manufacturer sites. We are not responsible for the privacy practices or content of those websites, and we encourage you to read their privacy policies.
13. Children’s Privacy
The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us and we will delete it.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Material changes will be posted on this page, and your continued use of the Site after an update means you accept the revised policy.
15. Dispute Resolution, Arbitration Agreement, Class Action Waiver
15.1 Initial Dispute Resolution Procedure
Notice of Dispute, Requirement to Attempt to Resolve Disputes Informally.
By visiting the Site and/or using the Services you and Dealership agree that if there is any controversy, claim, action, proceeding, demand, or dispute arising out of or related to your visit to the Site, use of the Services, or the breach, enforcement, interpretation, or validity of this Privacy Policy or any part of it (hereinafter “Dispute”), both you and we shall first try in good faith to resolve such Dispute informally by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party thirty (30) calendar days in which to respond to or resolve the Dispute. Notice shall be sent to us at ATTN: 4460 McHenry Ave. Modesto, CA 95356, and to you at the address or email we have on file for you. Both you and the Dealership agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. This notice and informal resolution requirement will not apply to the extent it is prohibited by law.
15.2 Arbitration, Class Action Waiver
IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE INITIAL DISPUTE RESOLUTION PROCEDURE, WE BOTH AGREE THAT THE DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS.
This means that if you and we have a Dispute that is not resolved in the informal process described in section 15.1 above, we both agree to resolve it through arbitration. Arbitration means that a neutral third party will hear both sides and make a decision. This is different from a court trial, where a judge or jury hears the case in a formal court setting and makes a decision. We both agree not to sue each other in court.
This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). The arbitration will be before a single arbitrator and the arbitrator’s decision will be final and binding on both of us.
The arbitration will be held pursuant to the rules of the American Arbitration Association – Consumer Arbitration Rules (if you are a business, the American Arbitration Association – Commercial Arbitration Rules will apply instead) (as applicable, the “Rules”). You can access a copy of the rules at: www.adr.org/rules. The Rules provide the steps required to start an arbitration case.
This arbitration agreement does not apply to Disputes that you or we bring against the other party that are within the jurisdiction of small claims court. If the amount in controversy of a Dispute in small claims court exceeds the jurisdiction of the small claims court, that Dispute will be subject to this arbitration agreement.
Class action waiver. We both agree that any Dispute will be handled individually. This means that you or we cannot join together with other people who have a similar problem to bring a single case against the other party. You also cannot be part of a class action lawsuit (or class action arbitration) against us, and we cannot be a part of a class action lawsuit (or class action arbitration) against you.
By using our Services, and visiting our Site, you agree to this arbitration agreement and class action waiver. If you do not agree, please do not use our Services or visit our Site.
If any part of this arbitration agreement and/or class action waiver is found to be invalid or cannot be enforced, the rest of the arbitration agreement and class action waiver will still apply. The arbitrator will decide if any part is invalid or cannot be enforced.
15.3 Other Arbitration Agreements
In the event of a conflict between this arbitration agreement and any other arbitration agreement between you and us, such as an arbitration agreement contained in a retail installment sale contract, purchase order, lease agreement, or repair estimate (hereinafter “Other Arbitration Agreement”), the terms of the Other Arbitration Agreement shall govern and prevail in each instance.
16. Venue and Choice of Law
This Privacy Policy has been made in, and shall be construed in accordance with the laws of California without giving effect to any conflict of law principles. Any disputes or claims not subject to the arbitration provision discussed above shall be resolved by a court located in that state and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
If any part of this Privacy Policy is found to be invalid or cannot be enforced, the rest of the Privacy Policy will still apply.
